Thousands of us moved to Portugal, started families, bought homes, and built careers based on the law that promised a path to citizenship after 5 years of legal residency. The proposed law seeks to increase this to 7 or 10 years and apply this change retroactively to residents already here. Milhares de nós mudámo-nos para Portugal, constituímos família, comprámos casa e construímos carreiras com base na lei que prometia um caminho para a cidadania após 5 anos de residência legal. A proposta de lei visa aumentar este prazo para 7 ou 10 anos e aplicar esta alteração retroativamente aos residentes que já aqui se encontram.

Violation of Legitimate Expectations & Legal Certainty Violação das Expectativas Legítimas e da Segurança Jurídica

Both Portuguese and EU law protect individuals who act in good faith on existing laws. We have a "legitimate expectation" that the State will not arbitrarily change the rules. The proposal violates this trust and creates profound legal uncertainty. Tanto a lei portuguesa como a da UE protegem os indivíduos que agem de boa-fé com base nas leis existentes. Temos uma "expectativa legítima" de que o Estado não alterará arbitrariamente as regras. A proposta viola esta confiança e cria uma profunda insegurança jurídica.

Unconstitutional Retroactivity Retroatividade Inconstitucional

Article 18(3) of the Portuguese Constitution forbids laws from retroactively restricting rights. By moving the goalposts for existing residents, this law has a *de facto* retroactive effect, making it unconstitutional in its application to our class. O Artigo 18(3) da Constituição Portuguesa proíbe que as leis restrinjam direitos retroativamente. Ao alterar as condições para os residentes existentes, esta lei tem um efeito retroativo *de facto*, tornando-a inconstitucional na sua aplicação à nossa classe.

Violation of the Principle of Equality Violação do Princípio da Igualdade

The arbitrary cutoff date of June 19, 2025, based on a political announcement, treats residents unequally. It lacks the objective and reasonable justification required by Article 13 of the Constitution. A data de corte arbitrária de 19 de junho de 2025, baseada num anúncio político, trata os residentes de forma desigual. Carece da justificação objetiva e razoável exigida pelo Artigo 13 da Constituição.

Disproportionate and Unnecessary Desproporcional e Desnecessário

Under EU law (as per the *Rottmann* case), Member State actions must be proportionate. The goal of ensuring a "genuine link" can be achieved without harming existing residents. A less intrusive alternative exists: apply the new rules only to new arrivals. De acordo com a legislação da UE (conforme o caso *Rottmann*), as ações dos Estados-Membros devem ser proporcionais. O objetivo de garantir uma "ligação genuína" pode ser alcançado sem prejudicar os residentes existentes. Existe uma alternativa menos intrusiva: aplicar as novas regras apenas aos recém-chegados.
